Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Bug Zapper Pest Control (“Bug Zapper,” “we,” “us,” or “our”). They apply when you visit bugzapperpestcontrol.com or use any website feature, form, content, or communication option we provide through the website (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. The Site Does Not Provide Emergency Services
The Site is intended for general information, quote requests, scheduling inquiries, customer support, and pest-control education. It is not an emergency service and is not continuously monitored.
If you face an immediate threat to health, safety, people, pets, or property, contact the appropriate emergency service or qualified professional.
2. Informational Content Is Not a Diagnosis or Service Agreement
Site content is general information and may not account for the pest, structure, occupants, pets, environmental conditions, or legal requirements at a particular property.
Photos, descriptions, automated responses, and other information submitted through the Site may not be sufficient to identify a pest or recommend treatment. A quote request, form submission, call, text, or scheduling inquiry does not by itself create a pest-control service agreement, guarantee availability, or confirm an appointment.
Actual services, prices, treatment scope, guarantees, cancellations, payment obligations, and other service-specific terms may be governed by a separate estimate, work order, customer agreement, guarantee, or other written terms. If those terms conflict with these Terms regarding purchased services, the service-specific terms control.
3. Quotes, Pricing, and Promotions
Website prices, savings, service descriptions, and promotions are subject to availability, eligibility requirements, service-area limits, property conditions, pest type, inspection results, and any additional terms disclosed with the offer.
Unless expressly stated otherwise in writing, website quotes and promotional information are estimates or invitations to request service, not binding offers. We may correct errors, withdraw promotions, or update pricing before accepting a service order.
4. Calls, Text Messages, and Form Submissions
When you provide contact information or contact us by phone, text, or a Site form, you represent that the information is accurate and that you are authorized to use the phone number, email address, and property information provided.
You authorize us to respond about your inquiry, quote, appointment, service, account, or related customer-support matters using the contact methods you choose or provide. Message and data rates may apply.
Consent to receive marketing messages is not a condition of purchase. You may opt out of marketing texts by replying STOP. You may still receive non-marketing messages necessary to address an active request or service relationship.
5. Acceptable Use
You may use the Site only for lawful, personal, or legitimate business purposes. You may not:
• Submit false, misleading, fraudulent, unlawful, or unauthorized information.
• Impersonate another person or misrepresent your authority regarding a property or account.
• Interfere with the Site, bypass security controls, introduce malicious code, or attempt unauthorized access.
• Scrape, copy, harvest, or use Site content or data at scale without our written permission.
• Use the Site to harass others, violate their privacy, or infringe any person’s rights.
• Use Site content in a way that suggests our endorsement, partnership, or sponsorship without permission.
6. Intellectual Property
The Site and its text, graphics, photographs, videos, logos, trademarks, design, layout, software, and other content are owned by Bug Zapper or used with permission and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for its intended purpose. No other rights are granted.
You may not reproduce, modify, distribute, sell, license, publicly display, or create derivative works from Site content without prior written permission, except as allowed by law.
7. Content You Submit
You retain ownership of photos, messages, reviews, and other content you submit.
You grant us a nonexclusive, worldwide, royalty-free license to host, copy, use, and share that content as reasonably necessary to respond to your request, provide or improve services, maintain records, protect safety and legal rights, and operate the Site.
You represent that you have the right to submit the content and that it does not violate any law or third-party right. We will not use a customer testimonial or identifiable image for public advertising without any permission required by law.
8. Third-Party Services and Links
The Site may link to or integrate maps, payment processors, scheduling tools, social platforms, review sites, or other third-party services.
We do not control those services and are not responsible for their availability, security, content, or practices. Your use of a third-party service is governed by that provider’s terms and privacy practices.
9. Site Availability and Changes
We may change, suspend, restrict, or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, error-free, secure, or current.
We may limit or terminate access when we reasonably believe these Terms have been violated or access creates risk to the Site, our customers, or others.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that Site content will identify, prevent, or eliminate any pest problem or that the Site will be uninterrupted or free from harmful components. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUG ZAPPER AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.
OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US, IF ANY, SPECIFICALLY TO USE THE SITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
This section does not limit liability that cannot be limited under applicable law and does not replace any remedies or limits stated in a separate service agreement.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Bug Zapper and its owners, employees, contractors, and agents from third-party claims, damages, losses, and reasonable costs arising from your unlawful misuse of the Site, your material breach of these Terms, or content you submit that infringes another person’s rights.
13. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.
Any dispute arising solely from use of the Site will be brought in a state or federal court with jurisdiction in Oregon, and you consent to personal jurisdiction and venue there.
Nothing in this section prevents either party from bringing a qualifying claim in small-claims court or limits rights that applicable consumer law does not permit you to waive.
14. Changes to These Terms
We may update these Terms periodically. The revised Terms will be posted on this page with a new effective date.
Changes apply prospectively when posted unless a later date is stated. Your continued use of the Site after an update means you accept the revised Terms.
15. General Terms
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, sale, reorganization, or transfer of the Site or business.
These Terms, together with any policies expressly incorporated here, are the complete agreement concerning use of the Site.
